Florida's No-Fault Law

Florida is one of a minority of states that require all drivers to carry insurance policies that include no-fault coverage. People with Florida auto insurance policies who are injured in auto accidents are entitled to benefits regardless of who caused their accidents.

Attorney Terence Gross is the author of the chapter on no-fault law in Florida Automobile Insurance Law, an official continuing legal education publication of The Florida Bar.

The law is complex, but the basic requirement is that drivers carry at least $10,000 worth of insurance paying no-fault benefits in the amount of:

  • 80 percent of medical bills
  • 60 percent of lost wages
  • $5,000 worth of death benefits
