Florida Uninsured & Underinsured Motorist Policies

Helping Accident Victims Get Fully Compensated

Normally, if you are injured in an accident caused by another driver, that driver's insurance company is responsible for compensating you for your injuries. However, what happens if the other driver does not have adequate insurance or flees the scene?

At the law firm of Gross & Schuster — with offices in Pensacola, Fort Walton Beach and Crestview — we help clients pursue compensation from their own insurance companies for injuries caused by uninsured, underinsured and hit-and-run drivers.

Contact us today to set up a free consultation with one of our experienced personal injury trial lawyers. You will pay no attorneys' fees unless we recover compensation for you.

Seeking Money Damages From Your Own Insurance Company

Uninsured and underinsured motorist (UIM) coverage is an optional part of auto insurance policies in Florida. If you have this coverage, your insurance company may be required to pay you benefits for injuries you've suffered in car wrecks caused by:

  • Uninsured motorists: Florida law does not require drivers to have bodily injury liability insurance. Although Florida law requires all drivers to have insurance, many people violate this law. When they act negligently and cause auto accidents, their victims may be left without a reliable source of compensation.
  • Underinsured motorists: Most drivers carry as little as $10,000 of motor vehicle accident liability coverage. This is often not enough to cover the damages suffered by people who are seriously injured or the families of those who are killed.
  • Hit-and-run drivers: If you cannot identify the person who hit you, you cannot pursue a claim against that person's insurance company. Uninsured and underinsured motorist coverage also covers hit-and-run accidents (also known as phantom vehicle accidents).

Unlike no-fault benefits, uninsured and underinsured motorist benefits are only available if the other driver was at fault. However, the compensation that is available may be greater, especially since coverage for multiple vehicles can be "stacked" under Florida insurance law.

Our attorneys advise all drivers who can afford uninsured and underinsured motorist coverage to purchase it so they can be better protected from negligent drivers. Contact us to discuss what we can do to help you pursue the UIM benefits you deserve.
